Terms of Service

These Terms of Service govern your use of the Merllou website, workspace access, and related support services. By registering or using the services, you agree to these terms and any applicable plan-specific terms. If you act for a business, you represent that you are authorized to bind it.

1. Services and third-party platform

Merllou offers business software access that may include CRM, websites, funnels, marketing, automation, courses, and related tools. Features, integrations, usage limits, availability and service behavior may depend on the underlying third-party platform and your selected plan. We may modify features or discontinue offerings with notice where required.

2. Accounts and acceptable use

You must provide accurate registration information, safeguard login credentials, and promptly report unauthorized access. You may not use the services for fraud, unlawful or deceptive marketing, infringement, malicious code, spam, unauthorized scraping, or other activity that violates applicable laws or third-party platform rules.

3. Plans, billing and renewals

Free and paid plans are subject to the limits shown at purchase. Paid subscriptions may renew automatically at the selected monthly or annual interval unless canceled according to the checkout provider’s applicable process. Prices are displayed in USD unless stated otherwise; taxes, exchange fees or provider charges may apply. The final checkout amount and renewal terms shown before payment govern your purchase. Merllou does not guarantee refunds except where required by law or expressly stated at checkout. Contact support for billing concerns.

4. Consulting guidance included with paid plans

Paid plans include access to business-oriented email guidance from Merllou consultants about using the platform and general operational questions. This is asynchronous, subject to reasonable-use limits and availability, and does not include a dedicated consultant, scheduled one-on-one sessions, implementation projects, guaranteed response times, or regulated legal, tax, financial, or medical advice. Separate professional consulting engagements may be available through addriannicolas.com under separate terms and fees.

5. Your content and compliance

You retain rights to content you lawfully upload, subject to rights you grant as needed to host and process it for the service. You are responsible for the legality, accuracy, permissions, notices, consent, and security practices associated with your business data, marketing campaigns, and customer communications, including privacy and anti-spam obligations.

6. Intellectual property

Merllou branding, site design and original materials remain the property of their respective owners. Underlying software, third-party trademarks, templates, and integrations remain subject to their owners’ licenses and terms. Your subscription grants limited use of the service, not ownership of the software.

7. Availability and warranties

We aim to provide a reliable service but cannot guarantee uninterrupted access, specific business results, compatibility with every integration, or error-free operation. To the extent permitted by applicable law, services are provided on an “as available” basis without additional implied warranties.

8. Liability

To the extent permitted by law, Merllou is not responsible for indirect or consequential losses, lost profits, or losses caused by misuse, third-party outages, or unauthorized access outside our reasonable control. Nothing in these terms excludes rights or liabilities that cannot legally be excluded, including mandatory consumer protections where applicable.

9. Suspension and termination

We may restrict or suspend accounts for nonpayment, security threats, serious misuse, or legal requirements, subject to applicable notice obligations. You may stop using the service or cancel a paid subscription through the available account or billing processes. Data access and retention after termination depend on platform capabilities and applicable law.

10. Governing law and disputes

These terms are generally governed by the laws of the Republic of the Philippines, without overriding mandatory protections that apply in a user’s jurisdiction. Contact us first so we can attempt to resolve concerns in good faith.

11. Changes and contact

We may revise these terms and provide notice when required. Questions can be sent to [email protected].
